Deceased father’s possessions being with held from family and son?

On October 19, 2009 / By Real Estate Law Help / In Washington-Real-Estate-Law / No Comments

I live in Washington state, where my step father passed away. As laws vary by county and state I am searching for someone who may be able to clue me on on what rights by brother (his biological son) and myself (giving power of attorney by my brother to handle my father’s estate) have in retrieving my father’s personal effects.
My father resided with a woman for 6 years. We are concerned she will be selling, auctioning, removing his belongings from the house they shared. There is no common law laws in Washington state, and after doing my research I’ve found she has no legal right to anything of our dad’s. The fear of her selling his things is very real as she has proving consistently to be a very calculating and spiteful woman with little care for anything but the money. Several days after his death she was speaking to a financial planner about probate for his estate. Additionally she has withheld documents of great financial importance regarding, debts and assets.
I want to know how I can legally insure she is unable to sell, pawn, barter, or otherwise get rid of his things. And additionally I would like to know if there is anything I can legally do to get the belongings out of her possession.
Please include references or links if any so I can use them in the future. Thank you!
In response to J. I have a lawyer. A very good one in fact. I want to know if there is some sort of injunction I can file or something to that effect. And if so what it would be called and if I am able to petition it myself. It’s not really about not being to afford a lawyer, more a matter of trying to cut the cost of the lawyer when I can.

Making a living in Washington DC?

On October 18, 2009 / By Real Estate Law Help / In Washington-Real-Estate-Law / 2 Comments

If you are a Washingtonian, then you know how DC is like a money making a machine. I hear a lot of people say you need a six figure income to live comfortably. There are some who try to strike it rich doing something that’s hidden, whether it is drugs, real estate, or you need connection to do something big to blow up.
Please help me dispel this myth of doing some magic to escape the rat race, or tell me what people are really doing. I am not talking about those who work as professionals in the medical field, the law, or top positions in the government.
This question is specifically for DC although there is hustle hustle in major cities, there is a certain dark vibe I get about DC.

What is the law regarding cash/gifts exchanging hands in real estate transactions in Washington State?

On April 23, 2008 / By Real Estate Law Help / In Washington-Real-Estate-Law / 2 Comments

I am a fairly new agent in Washington state and work by referrals. I really want to get a certain client and would like to offer them a $250 Home Depot gift card after closing if they allow me to refer them to a specific agent. I know that no cash can change hands except in escrow, but what are the rules regarding gift cards, etc? When I first purchased a home before I was an agent, my realtor gave me a gift card after closing although I was not promised one in the beginning. Am I allowed, by law, to entice a referral with a gift card or would that be considered cash? Any answers greatly appreciated
