I am aggravated at the way in which my fathers estate is being handled by his executor. The person appointed to settle my dads belongings, real and personal, has done virtually nothing for the last year. Meanwhile, real estate is being vandalized, personal property is being stolen, cars are deteriorating, property taxes are being racked up, and late fee’s on bills are through the roof.

My question is specifically, how long do the courts allow for an estate to be settled, and what can be done about gross mismanagement of an estate in North Carolina?

Are there any legal implications to having first dibs to purchase a real estate property such as a home? I’m asking about laws in Canada.

My new tenants just asked to have first dibs if we decide to sell our home. Is this just a courtesy or does it have any legal implications? Are we bound by this in any way?

Since I’ve had several responses, most out of State. I am looking for a Real Estate Professional, or Lawyer to help answer my question. I need someone from NY to assist me. The county involved is Monroe County.

I am interested in a property that currently does NOT have a mortgage, its 100% paid for. My dilemma is that the house has back taxes on it. 2007 is currently held by a third party, and 2008 is delinquent and held by the county. I know the person will not be able to pay the taxes. I would like to know how to legally obtain the property, before it gets foreclosed, or seized by the town/county. The house is not for sale, and I don’t know how to approach the situation.

Aparently you people don’t understand. I want to find out how I can offer to purchase the house from the owner. My last few postings, people actually paid attention that I wanted information from Real Estate Professional, not some person off the street who thinks they know the answer. Canadian real estate question re:property lines?

Anyone out there who knows Canadian (BC) real estate law? Here is my problem:

We bought our home in 2005, taking the existing fence line as the legal line. I have since discovered that our neighbour’s driveway is actually on my property. Property surveys, the steel pegs, etc, clearly show the problem.

The back half of the property has a fenceline that is correct. From there, it angles over so that the steel pg is smack in the middle of their driveway (about 5 ft from the fence at that point).

Now, up until just before we bought, the neighbours and our previous owners shared the driveway, so it was a moot point. But then our sellers built a brick post and the fence that goes with it. Effectively, the owners of our property delineated the line.

So a two part question:

First, can I legally require my neighbour to give up his driveway (he has another entrance on the other side of the property).

Second, if I do NOT make an issue of it, am I somehow granting my neighbour some sort of rights in the future?

On May 1, Faith, a real estate agent, and Grace, a commercial property owner, sign an agreement to find a buyer for Grace’s office building. Under the terms, if a buyer makes a serious offer within sixty days, Grace must pay Faith’s commission. Faith puts signs on the building, ads in real estate pamphlets and a local newspaper, and features the property in a "walking" tour on the Internet. On June 1, Grace tells Faith that she is canceling their arrangement. Ten days later, Grace closes a sale on the building without Faith’s participation.
