Paralegal information?

On November 3, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / No Comments

I am thinking about doing the paralegal program at my college. Does anyone know from experience the specific job duties and salary?
I was looking at information online and some law firms pay more for paralegals with experience in real estate. (I am going to have my real estate license next month)

is it a good job?

house legal advise, ex trying to take advantage –please help?!?

On October 15, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / No Comments

Hello,

I have a huge problem with my ex and our house that we share. To sum up the story, we were never married just engaged when we bought the house in 2006. We broke up 1.5 year ago and I moved out since he wanted to stay and make payments. We had a huge fight when we broke up. He tried to have me sign the deed of our house over to him and still keep my name on the mortgage. In addition to closing and taking our savings that we had. This was all after, I agreed to take half of his credit card debt (all in his name) since it was our debt technicaly and I felt quilty of him just paying back for it. This was all before the deed scenario.

We sort of had a falling out and things just remianded where he stayed there and was making payments. Now, he started to email me again regarding the house, I received 20 emails in about a week from him. I’m just scared that he will take advantage of me, he is foreclosure/real estate attorney and I’m having a hard time believing him especially after the break up. He’s deceived me so many times in the 6 years we were together in every way possible.

He is telling me the new options that are available and that we could finally resloved this situation. Here is a snap shot of the email that I got from him

"1. Prevent damage to either of our credits.
2. Ideally, get rid of the house either via short sale, deed in lieu (which
means give the house directly back to the bank), or principle reduction and
then sell. I don’t need a 3bd house at $2k/mo. This depends on what the
bank will agree to. It’s not in my control, but I will pursue and argue for
this as much as possible.
3. If getting rid of the house is not possible and we are stuck with it for
now, then I would at least like to reduce the payment via an interest rate
deduction."

This was all after he told me how he was doing very well with his law firm in the inital email and that his accounting (he’s a cpa as well) contact expired and he can be considered unemployed giving us a golden ticket out of this mess. I just don’t know what to think, he wants me to send my documents to our mortgage bank so they can look at the options. I told him I would do this monday after he kept emailing me non stop. Do you guys this I need to get a lawyer and if so what kind rela estate/family. I’m so scarred of him and I don’t know what to do nor do I have any $ to do anything. I work and go to school and I’cant afford any extra attorney expenses. Can someone please give me any sort of advise, I have no family/friends to turn to. I’m scarred for my life and I don’t want to have anxiety attacks like I used to.

To emails that he sent were vague and he initially wanted to do a modification option but now he is saying he’s ok financially but wants the option #1 in the email. He is always vague and always has a alternative motive with everything. To make things weirder, he emails this to me after he breaks of with his gf (who’s company is moving into my office bulding, on the same floor on monday). He sent me an email the next day after they break off. I also know some people at his gf compnay since my ex used to work there (he got her a job there) and I’m freaking out even more.

I don’t know what to do. I feel so scarred and I was on medication for a year due to our break up and the aftermath that occured. All of ‘our friends’ stopped talking to me since I met them through him (incuding the one’s that are moving in next door), At one point I even tried to kill myself by overdosing on my medication. I thought I was ok since I’ve been seing a therapist but him emailing me has brought everything back.

Sorry for the long question. Any advise would be appreciated. Thanks

I also tried to call the free government number they have available, but they don’t seem helfpul.

How do you know if a house is foreclosed on?

On October 15, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / 4 Comments

I have been renting a condo in California since August. I received a Notice of Trustee’s Sale posted on my door in the beginning of November. My landlord assured me there is nothing to worry about at the time. Just after I paid the rent for December, I received a Notice to Quit from a law firm on my door and that I have 60 days to vacate the condo. My landlord still claims he owns the condo. I received a notice from a real estate broker claiming to represent the bank, he is trying to make a Cash for Keys deal. I started looking for a new place to live, but I do not know who to trust. How can I find out if my landlord still owns the condo or it is foreclosed on? I do not want to break my lease contract. If the bank really owns the condo, is the security deposit transferred to the bank? If the landlord does not own the condo, can I demand to get my security deposit and the December’s rent while I still occupy the condo? I kind of need the money to pay for a new security deposit
I would really appreciate your advice.
Thanks a lot in advance,
Thanks for all the answers so far.. Is my security deposit transferred to the bank or does it stay with the old landlord? As it has been stated, can I sue my landlord for the security deposit?

Do we owe the realtor any money per CA state law?

On October 15, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / No Comments

Wondering if you can help me with this question. My folks put their house up for sale in Anaheim, CA, signed a contract with a realtor and did not sell the house. The contract expired with the realtor and she moved to another real estate firm. They did not have the house listed for 3 months and now someone who looked at the house about 6 months ago came by and offered to buy the house without any realtors. Would they owe the realtor who had the open house six months ago any money?

I’m a realtor in NJ but worked a part time job which I have now been let go from - can I collect unemployment?

On October 12, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / No Comments

The part time job was at a law firm down the street where I worked for steady income but now they hired someone full-time and they let me go. I’ve earned commission from real estate last year but obviously not entitled for unemployment from real estate broker because I am an independent contractor and still am but can I collect for this part time job? Obviously if I earn wages from real estate while on unemployment I will notify them for that week.

What to do about Co-Worker?? HELP?

On October 12, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / No Comments

I work as one of two legal assistants at a small law firm. I handle the court cases and grunt work while my co-worker is the "office manager" (a title she gave herself) and handles the check book and real estate issues. We make the same pay, but she has been there 9 months longer, but I have more education.

This is the problem: Although my boss has instructed her to teach me to do everything in the office since he is rarely there, but she refuses to. I have even asked her several times to let me help her with work, but she says "she barely has enough to do herself." I think that she is afraid I might replace her and is wanting me to be "naive" so she has job security.Although that is not my goal, I have two children and do need job security too! She is leaving for a trip to Peurto Rico in two weeks and I do not know enough to run the office efficiently? What do I do? No jokes please, only serious advice!

Questions asked in this Legal Memorandum?

On October 8, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / 1 Comment

Assume that you are a newly hired lawyer in a law firm. On your first day, you received a memorandum from your supervising lawyer:

To: Atty. Neophyte
From:Atty. Bossing
Date:23 September 2009
Subject:The Curious Case of the Paranoid Mayor

Below are the relevant facts related to us by our client, Mayor X of Bamboo City who came to our office yesterday for advice. Kindly go over the facts, and thereafter draft your opinion on the matter.

Mayor X of Bamboo City had, since the start of his office, always wanted to close down the radio station BBBB. According to Mayor X, Radio BBBB had always been critical of his administration. Radio BBBB is located in a sleepy and quiet town called Maingay in Bamboo City. For several years since 1990, Radio BBBB had been diligent in paying the necessary local and real estate property taxes, as well as in securing the necessary permits for its operations. In his effort to realize the closure of the station, Mayor X thought of a plan to withhold the renewal of Radio BBBB’s business permit until such time that the station had submitted a certification of conversion from agricultural to commercial land from the DAR, although he admitted that the town of Maingay had long been declared a commercial area under the City’s zoning plan.

Mayor X will be waiting for our opinion on whether he should remain resolute on his stand not to issue any license to Radio BBBB. Mayor X only had until the 29th of September to withhold the renewal of the license. Kindly submit your draft opinion on or before 28 September 2009, 5:00 p.m.

Would working for a law firm unrelated to your specialty area be ok?

On August 1, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / 1 Comment

My specialty area is zoning, land use, environment, and real estate.

I got an email from a lawyer about possibly working for his bankruptcy, debt collection law firm.

I know nothing about bankruptcy and debt collection…is that a good or bad idea to working for something I know nothing about but can’t find a job for the other?

Work hours for attorneys?

On May 29, 2009 / By Real Estate Law Help / In Real-Estate-Law-Firms / No Comments

Say I wanted to be an attorney because I greatly enjoy the law, research, reading and writing but don’t want to work as much as some attorneys do. I’ve heard horror stories. I would not spend my 20s working 50+ hours a week in an office.

However, I also don’t care about making that much money. I’ll work less for less pay. I don’t care about being a powerful corporate attorney or partner in a major law firm. I just have other priorities.

I’ve heard that in order from the least workload and therefore hours to the most, that government attorneys work the least, followed by small firms, then mid size then large ones. Additionally, a lawyer in NYC will naturally tend to work much longer hours than one in Valdosta, GA.

Finally, is there anyone specialty that works more work than the next? Is criminal law more “intensive” than say Real Estate or Bankruptcy Law, etc?
