I understand they buyer usually has 10 days for inspections and repairs where he can technically back out. After that, all the buyer loses is earnest money. What about the seller? TS?

I’m in a Real estate contract but the buyer will not release the contingencies. What can I do?

The buyers agent appears to be playing games and refusing to sign off on contingencies so that we have 100% of the liability, I am prepared to terminate the escrow. Do I have any legal recourse? I would love to sue this buyers agent who has lied about everything from a hospital stay which prevented the submission of documents on time to client meetings that never happened.

Not allowed to leave the office for lunch?

On October 26, 2009 / By Real Estate Law Help / In Real-Estate-Contracts / No Comments

I have been working as a receptionist/administrator for a real estate company for over a year now. I always bring in my lunch & eat it in the staff room so it has never been an issue before now. I forgot my lunch today so my boyfriend offered to take me out on a lunch date. I went out for lunch & when I came back my boss flipped out & said I wasn’t allowed to leave the office during breaks in case he needed me to type a contract or ask me a question (he does often interrupt me at lunch to ask me ridiculous things that easily could have waited half an hour)

Surely this is illegal?(the not allowed to leave the office part, not asking dumb questions)
I am on a full time salary with paid breaks.
it may have been prudent of me to mention I live in Australia..oops

Are you personally liable for any real estate contracts you’ve signed, POs on Equipment you never paid, money loaned from banks, etc? Or can you just walk away from the defunct business the next day with nothing lost other than whatever you put into the business?

We completed a contract to purchase a home. Our agent did not mark the financial contingency box as we had our financing all approved. We were told the payment amount before we made the offer. Once the offer was accepted, the payment amount came back substanially higher. The broker had made an error. Now we can’t afford the house and the seller is threatening to sue us. State of home purchase is WI.
It’s not that we can’t qualify with the higher payment, its that we would never have offered to purchase had we been quoted the higher payment in the first place.

In real estate "contract note" what is the default time for the offer to lapse?

On October 13, 2009 / By Real Estate Law Help / In Real-Estate-Contracts / No Comments

I made an offer for a house, but the real estate agent convinced me not to put lapse time for the offer. Now I realize I made a mistake and should have specified a time for when my offer is not valid after. Now I would like to know if there is any default number of days that my offer is considered void, or stale. I would appreciate if someone can tell me how long it is, otherwise I would be waiting for long time till the vendor decides.
