I have both a law degree and real estate brokerage. I just finished law school and what I am planning on doing is specializing in estate planning (drafting living trusts, etc.), but also assisting my clients with their real estate needs such as listing and selling their homes, etc. In the part of the country where I live (San Francisco) Real Estate brokerage commisions are still very substantial, and in fact, I would venture to say that I would probably make more money through my real estate services than my legal services if I offered a "one stop shop" sort of business where people go to me for both legal and real estate advice. My question is, how feasible would it be to combine an estate planning legal practice with a Real Estate brokerage servie? Has anyone ever known of an attorney who also did Real Estate on the side? Any thoughts would be greatly appreciate





My real estate attorney is requesting that I do some ‘big time’ lying to benefit me financially "???????
Is this common??? The defendant will not be showing up to court, nor any represenative of theirs. My attorney will be making a lot of money and so would I. I dont want the money, however, I have a business partner who befriended the attorney, and I owe my partner some money, and they are acting like it is just a one time thing. I feel guilty and wrong about this. Why doesnt my attorney??
PS: I also understand that I will be under oath and that there are other precautions to take, however I have been through this process before, but have never had to do the lying that he and my partner are requesting me to do.
If I wanted to be a real estate attorney, how would I get started? what are the steps?
I know I would need to do my undergrad, and take my lsats, but what about after that? are there certain concentrations you can have in law school? any help would be great
Are there any states that don’t have both buyer and seller real estate agents, i.e. only dual agency?
I know there is a lot of controversy about whether dual agency should be outlawed. I was curious with the great variety of real estate transaction practices across the country if any state had only dual agency. Actually it could work for non-real estate agents as well, i.e. real estate attorneys.
Would this be real estate fraud and would it be a criminal case or a civil case?
We are purchasing a house (owner carry) from a man who said he has an owner carry contract with the legal owner so it is a sublease. The legal owner after 2 months is telling us that he (the man who sold us the house) does not have any legal ties to this house and was only the caregiver. We are still in the house and spent thousands of dollars remodeling the house because the condition that it was in was not livable. The legal owner is threatening us and saying that we are trespassing. The man still claims he has a legal contract with the owner but has yet to produce it. We also have a legal contract with him, pictures of before and after, receipts and many witnesses. We have an appointment with an attorney next week but I am unsure if we should be getting out of this house now since we now are being told that there may not be a legal contract between the legal owner and the man who sold it to us. We also gave him money as a down payment. Can we press criminal charges? Wouldn’t this be theft? What should we do now? I cannot continue to wait for the police to remove us or could they?

I need to know if this is legal or not:
I live in an apt complex in MILLBRAE, CA and the owner of our building has increased our rent. Now, he has given us the adequate time frame for notification but a lot of us tenants have been asking each other if they received a letter and/or increase. A LOT of tenants have NOT received ANY notices about rent increase and do not have to pay. It seems as though the owner is picking and choosing apts he wants to increase. Here are my questions:
1) Can he pick and choose rents he wants to increase?
2) If he intends on increasing the rent, doesn’t he have to notify EVERYBODY of such increase?
3) If any of the above or not legal, as a tenant, what can we do?

I am suing former Real Estate Broker; taking a toll on my health, what do I do?
I just turned 23. When I was 20, I thought I knew what I was doing. Instead, I decided to purchase Real Estate with a broker I thought I could trust. Unknown to me at the time, the Brokers were con-artists who forged documents, appraisals, employment information, and even IRS tax forms under my name.
I have taken matters into my own hands and I have sued them in Circuit Court. I took this step after realizing attorneys are way too expensive, especially for a case like this. However, after a 40-page Complaint, two 20-page Memorandum’s of Law, and several other pleadings; along with a full-time job, and full-time status as a college student, I simply can’t handle the stress.
My "stress" therapist thinks I should drop the suit. I am miserable beyond words, but I feel like I can’t give up. I have submitted a Complaint to the local police department, but these people are still in business. I feel like I owe a duty to the community to stop these crooks.
To make matters worse, their insurance carrier is paying for their all-star lawyers. I have a $300,000 claim on the table. I don’t know if that’s worth my health and my happiness.
I am in need of some wise advice.

Legal Question regarding being power of attorney?
This is a serious question regarding being power of attorney. Recently, my neighbour passed away. My mother took care of him during his illness with Dementia since 2001 while his real family didn’t want to have anything to do with him. My mother was power of attorney while this man was alive. Before he was sent into a nursing home, my mother took care of this man. She drove him to all his medical appointments, cooked all his meals, chased him around town so he wouldn’t get into trouble, pulled him out of bars, lost vacation time at work to take care of him and maintained his house before he fell seriously ill. When he was diagnosed with Dementia, she went through the whole process of getting him in a nursing home and she had to purchase a cell phone because she was on call 24/7 for his needs. The time that it took to care for him took away from her full-time position and her family.
I understand that the power of attorney ends at the time of death. My mom arranged the funeral, contacted family and the estate has been left to his niece on his wife’s side of the family. Is there a law that my mother should be awarded 5% of the estate? She was next of kin on the death certificate.
The niece is threatening to take my mother to court due to extra withdrawals that were made from his account while he was alive. The moneys were used for car maintenance, gas and holidays which she had to book for emergencies for him.
The niece in question had rarely visited him while he was residing in a retirement home and at the nursing home. Does my mother have any rights in this matter?

All the money that was used was from his account. My mother had access to his account while she was power of attorney, therefor, nothing can be reimbursed.
Will my mom need to pay back the money that was taken out of the account to take care of him? The niece expected to have plenty of money when she got the will but there is hardly anything left in the account. Now she is threatning to take my mother to court regarding this.

I am thinking about becoming an attorney when I grow up. I’m pretty smart, so I think that even the keen competition won’t keep me from getting hired for long. However, I would love to know if there are any existing fields in law (divorce, real estate), that are less saturated and that one might benefit from going into. Thank you.
