Can credit card companies put a lien on my house and force a sale with Chapter 13?

On October 23, 2009 / By Real Estate Law Help / In Oregon-Real-Estate-Law / 2 Comments

We’re in Oregon so I need someone to answer this that understands state law. Our mortgage is easily paid however we have $40000 in unsecured credit card debt. As of now we can no longer pay minimum payments to credit cards but are up to date with our mortgage. We owe $215K on our house but the property tax says it’s worth $279K. I haven’t had a real estate appraiser out yet but I know it’s not worth $279K. We have an exemption in Chapter 13 for what we owe up to $39000 for husband/wife. Can credit card companies place a lien against the house and force foreclosure or do they have to wait until we sell the house in the future before collecting?

DBA’s for Real Estate Brokers, legal name vs. operating name?

On April 22, 2009 / By Real Estate Law Help / In Oregon-Real-Estate-Law / 1 Comment

I’m in need of some answers. I will be a newly licensed Real Estate agent/broker this next week. State (Oregon) law requires that you are licensed under your LEGAL name. My concern is that I am getting married in 4 months and my last name will be changing. The first part of your Real Estate career is getting your name out there and known. I’m trying to avoid giving one name to the public and then changing it months later. Not to mention, business cards, my website, etc.

Is there anyway to operate under my future last name WITHOUT legally changing it. (As then my maiden name, would be my married name.)

The State is giving me run-around, ambiguous answers (and not ones that I really want to here.)

Can someone help me!!??

Oregon Real Estate Law: Selling a rental property?

On May 9, 2008 / By Real Estate Law Help / In Oregon-Real-Estate-Law / 2 Comments

Under Oregon State Real Estate Laws, isn’t a landlord required to notify their tenants if they put the rental property up for sale? I know that they have to give a minimum 24 hour notice of entry to show any prospective buyer your rental unit, but I need to know if they are supposed to let the tenants know that the property is for sale.

Do you have to take a class before taking the examination to obtain your real estate license?

I’m wondering if I can just study Oregon Real Estate law or do I have to pay big bucks for school first?

Does Oregen law prohibit auctioning houses?

On February 28, 2008 / By Real Estate Law Help / In Oregon-Real-Estate-Law / 2 Comments

A friend who is a real estate investor (she’s new to the game) in Oregon tells me that Oregon law prohibits the auctioning of houses. I cannot imagine a reason for this and I’m wondering if perhaps she’s misinformed.

Are any of you aware of such a law? She said it’s reasonably new.

Oregon real estate agents can’t be rental agents?!?

On January 12, 2008 / By Real Estate Law Help / In Oregon-Real-Estate-Law / 2 Comments

Is it true that if you’re a real estate agent in Oregon, you can’t be a rental agent? I just bought some rental property up in Portland, and I was going to ask the agent who helped me on the purchasing end, if she would help me find tenants. She said it was against Oregon law. Can someone confirm this, as well as explain the reason for it? Thank you!
The agent that I used would have been happy to rent out for me. But I thought I’d double check anyway. I started using a management company, but I wished it could be her instead.
