Is it okay to buy a house that was flipped?

On October 12, 2009 / By Real Estate Law Help / In Ohio-Real-Estate-Law / No Comments

I have been in the real estate market for awhile and I’m wondering if I should steer away from houses that have been flipped? I’ve been extremely cautious, but I have looked at a few open houses that was flipped by a specific realitor. The houses they rebuilt look nice and most updates include electrical, plumbing, and roofing. It is a concern if these updates were updated correctly, but if I hire an independent inspector and the house passes, should it still be a concern if the house was done correctly or could i rest in peace?

Lastly, if a house has been flipped, is it by law (in ohio) the contractor must warrantied/guarantee the work?

thanks.

How do real estate auctions work?

On October 12, 2009 / By Real Estate Law Help / In Ohio-Real-Estate-Law / No Comments

My parents are trying to repurchase land (39 acres) that was owned by the family. It was sold about 2 years ago, and now the people who bought it are selling it - or actually, they are auctioning it (this is in Ohio). We can’t seem to get a lot of information from the realtor or auctioneer about how this all works. Is there a site that I can go to that gives all the ins and outs, the laws, how it works, etc? Also, the land is being divided into 4 sections (my parents are going to bid on one sections). Each section is going to be auctioned, but then, they are going to do a seperate auction for the whole property. If the bid for whole property is higher than what each section was bidded for, then it cancels out those bids for individual sections. This doesn’t seem fair. It seems it should be one way or the other. Any thoughts on this? Also, is there usually a reserve price? My mother was told there wasn’t and she is pretty much having to guess how much to get a loan for based on what one acre is worth right now. Also, is there a certain amount of money that they have to bring to the auction - like 5 or 10%? One more question, the current owners tried to get it so that my parents could just purchase the section they want, and then auction the rest seperately, but they were told they can’t do that? Is this true, and why?

ohio real estate laws?

On August 8, 2008 / By Real Estate Law Help / In Ohio-Real-Estate-Law / 2 Comments

We recently purchased a home and the seller did not disclose all known defects of the home. We are asking for financial help in making the home safe and comfortable. It appears the home received "handyman" repairs so it’s apparent the defects were known.

We asked for help and got a letter from an attorney saying the matter is complete and no payment forthcoming.

We would like to take them to court but cannot afford the attorney fees. What recourse(s) do we have?

I want to sell my house without a real estate agent?

On June 18, 2008 / By Real Estate Law Help / In Ohio-Real-Estate-Law / 8 Comments

My husband and I live in Ohio. We are wanting to sell our house ourselves. My main problem with this is I need a contract. There are a ton online to buy but how do I know I’ll be able to understand it, or will it be what I want. Some say seller has to pay for inspection, etc. I don’t want one like that. I also know laws vary state to state how do I know this one is legal in Ohio? Is there anywhere to get one for free or a good book to get. Maybe some software. I just want to see it before I buy it. We also don’t want to spend a lot on it. Our home needs work and we are just wanting what we owe. Any and all help is appriciated! Thanks!!
We probably already have a buyer. A man owns practically our entire block and rents all the houses out. He has inquired several times about us selling to him. He knows how much we paid- we offered more than him so we got the house. He is not going to pay a lot. A friend of ours actually had to borrow money to pay their real estate agent- we definitely don’t want that. We just really want to be rid of it. That helpusell.com site doesn’t seem to be working- I’ll try again. Thanks!!

what is the ohio law concerning useage of property belived to be owners but actually it belongs to neighbors?

On April 28, 2008 / By Real Estate Law Help / In Ohio-Real-Estate-Law / 2 Comments

my real estate law is long forgotten. However I know there is a law that stipulates that if a property owner unknowingly uses adjacent property belived to be his it does become that persons property after a number of years.

Does anyone know how much a real estate paralegal would make per hour just starting out at a small law office? I’m in NE Ohio and I’m close to finishing a 2 yr. degree. I’ve been offered a job but not sure what to ask as far as pay. Thanks.
