I recently purchaced Tom Butler’s Short Sale Magic course and all the information contained in the material seems very benificial. However I know that North Carolina has laws in place that hurt some Real Estate Reseller’s. Can anyone tell me a legal way to control Real Estate in NC without aquiring personal financing nor triggering the "Due on Sale" clause that is in most mortgages.
An example of this would be assuming the property "Subject To" current owners mortgage. Not sure if this is legal in NC, but any legal creative financing ideas are welcomed…
I am taking a test tomorrow my final for my real estate class and can not find this answer. When signing an exclusive right to sell contract, a provision can NOT be added. There is a law against it. I’m not sure if it is a federal law or a state law. I am in North Carolina. Can anyone help me with this? What is the provision that can not be added and what is the law against it? I have searched my book and can’t seem to figure this out.
I have a few questions but the most important question is What can I do?
Situation
My husband and I bought a house brand new in 2004 from the builder Pine Grove Corporation
There was a drainage stream about 4 foot wide and maybe two feet deep when we purchased the home in the far back corner of the property. Since my family home has a creek that floods we asked if this creek would flood (The answer to that was no it will not flood the stream it is just a run off for rain} Well it floods and floods bad one neighbor just lost their house over their little run off and I had to be taken from my house in a rescue boat even though the water never made it into the house itself just up to the porch) On our survey from the builder it states that there in no creeks, streams, lakes, river, or running water near the property,
Question How can they state this when it goes through everyone’s property?
Next Situation
The family that lost their house the insurance company is still going through their case but they found out the builder did not have the permits to build our houses where he did, his company built 20 house in wetland?
Question
What if anything can the home owners do? Can we sue the builder? And what are the odds of us winning?
I think he should at least buy the houses back with the land since it came in a package deal when he sold it. I don’t even care about the thousands I have put into this house I just want the builder to reimburse the homeowners on what we paid him.
North Carolina divorce law requires that a couple be separated a year before they can divorce. I’m living in Texas now and have several months before I can divorce. Our separation agreement isn’t done yet but we have established our "separation date" which like a time stamp on everything that happens from here on out for us.
Does Texas lawy allow me to buy a home in Texas even though my out-of-state divorce won’t be final till early next year? (Seems a waste to rent for a year when I know where I’m going to be.)
can you withdrawl a real estate contract prior to closing in North Carolina without penalty?
I listed through a real eatate agent, some bare land I own. I would like to remove it from the market before the time on the contract expires. There are no offers or contracts on the property. I have had a change of heart regarding the sale pf property which my family has owned for over 100 years.
Anyone know what the law is concerning this?

I understand that morally, most relators would cancel a listing upon request. I was more concerned with any laws related to doing such. Usually, there are cancellation clauses in the standard contracts. In my home state, there are such. I looked at the doc’s from NC and found no such provisions for cancellation.
Again. I am looking at the legal ramifications to canceling.
