Question for real estate agents/brokers about advertising laws (IL)?

Someone bought the house across the street from me. It was a foreclosure. They fixed it up and are now reselling it. They have a sign out in front of the house for sale with a flyer. Sign and flyer say "St. [current rehabbers last name] Properties" with a little picture of a cartoon house and the phone number. The address is a P.O. Box, no street address listed, no specific agent/broker name, cell phone number only. No fair housing logos or anything. And it lists the property as 4 bed/2 bath when I know for a fact that one of those bedrooms and one of the bathrooms is in the basement.

This is in IL. I have my real estate license, but I am in commercial. I know there are numerous things wrong with this advertisement. If it is for sale by owner doesn’t it need to say that? Who does this guy think he is pretending to be a real estate company when he has neither a broker’s nor a salesperson’s license? I googled the name of the "company" and didn’t find anything. Also checked the IL Dept of Regulation and nothing coming up under that name.

As someone who keeps up with the continuing ed and fees associated with maintaining my license, this is ticking me off. Can someone clarify residential advertising rules in IL? Am I overreacting?
Leo I asked because I didn’t know. I know you don’t have to have a license to sell your house yourself, I was asking if there were guidelines for someone representing themselves as a real estate company. What a person can do who is NOT a broker and NOT an agent did not seem to be a big topic in any of my real estate classes, so you didn’t have to be so rude about it.

Are there any rent control laws for non-residential tenants?

Does anyone know of any place or ordinance that provides some form of rent control for leases on non residential property? for the small independent business owner? The mom and pop corner store?

I am so tired of seeing yet another cell phone, cable, loan stop, check cashing, and real estate brokerage move in to the spaces where those unique wonderful little shops, owned and operated by the locals, once flourished. Commercial landlords can be just as greedy as the slumlord owner. It just seems wrong to force out a meaningful local member of the community and replace with yet another piece of big business blight!

I’ve witnessed the rent-induced demise of too many great local businesses: such as my local guitar and music store, my vacuum repair shop, my jewelery repair, and one of my favorite little independent grocery stores. All of these proprietors were forced out by greedy and unscrupulous landlords who imposed impossible increases in rental rates. (some increases were 25-45%).

I would love to hear from any one out there who knows of a city or locality with protections in place for their small business owners with regards to rental increases.

my tenant is trying to sublease the property they are still paying rent. they have moved out,we cannot get a key to our property handled by a real estate agent..when i get in touch with said realtor he wants me to sell my property to him..he was very aggressive, and wont give us a key to the property, because he wants it..what to do?? CAN I GET A KEY MADE FOR MY PROPERTY??i have written several letters to my tenant asking for a key.how long befor i can get a key made?? WHATS THE Law?? How to get one person off a combined lease (commercial property)?

Im currently in a lease, im a guarantor, but have sold my half of the business to my father. The lease stipulates that should the lease be surrendered and someone else takes it up a new lease will be written up, and the landlord must agree that the new lessee is suitable as far as business experience.

Now one would assume this would be simple right? simply go to the landlord and ask, but what if they contest it? Im in Australia by the way.

Please quote sources so I know im not being mis-informed, unless ofcourse you’re familiar with this kind of thing, then just quote your experience in the real estate or law business.

In a small town with zoning laws a Wal Mart outgrew it’s store and elected to build a new one but didn’t have enough room. So they selected a sizable piece of land at the edge of town and built a new store there. This, of coures, left the old store vacant and for sale. It was within the city limits and zoned commercial. An existing church at the outskirts of town wanted to enlarge but had no room. They bought the empty Wal Mart building. But, when they announced what their plans were the city said, "Whoa, wait a minute. You can’t build a church there because the land is zoned commercial not religious. The church insists that they WILL build a church there. The town insists that they WON’T. Can you advise as to who is right and why

If I sublet part of the home that I recently purchased and live in, could I get the $7500 rebate?

Subletting part of the home would, I think, make that part of the home commercial real estate for taxation purposes. What if I buy the home in 2009 and do not sublet until after the subsequent tax filing? I want to make sure that I am not breaking any laws. Thanks.

2 Job Offers: Real Estate Tax Law or Commercial Litigation?

Hi Yahooligans!
I received 2 job offers, both are legal assistant/paralegal positions. Both are small boutique law firms and located in the same vicinity.
One specializes in real estate law and minimizing taxes (starting $28,000 and 3 month probationary period) and the second specializes in commercial litigation (starting $35,000 and 6 month probationary period).
Which would you choose and why? I’m leaning towards the commercial litigation law firm because of the money and I feel commercial litigation is more broad. Thanks for your time and advice!

Does anyone know property/real estate laws in Houston or Katy Texas?

I moved into a new community in Katy, Texas 10 months ago. Upon making our decision to buy this lot, we asked our home builder if there were any plans of construction going on with the land behind it. They said "nothing that we are aware of" They just said it is commercial property and nothing else. 4 months into living here, a contractor started breaking ground for what is now becoming a 2 story concrete warehouse that is 15 feet from our back fence. It is almost as tall as the power lines that run across the back of the community and it blocks about 75% of my view from my patio. The loading dock is right behind our house. My view of our gorgeous Texas sunsets is now gone. Do I have any rights? Are there any rules or laws of disclosure that I should have been informed of? I feel extremely cheated. I chose this lot as we didn’t want a 2 story homeowner overhanging our back yard. Now we have a commercial one….Any advise would be great.
