How can I find out the "Law" regarding Real Estate, Your Property, Strip Club opening, see Details????

On August 22, 2008 / By Real Estate Law Help / In Real-Estate-Property-Law

summing it up:
live in small town.16yrs, same home.
one entrance, one exit.
space on left. worn out building, Bar, Bar, Bar, Restaurant, ?, Strip Club….in between all who opened the place. It has been closed. Run down….
Now, this guy in the adult entertainment business all over, "leases" the place….Remodels it, it looks so nice right now….
(Till he puts the sign, "The Sugar Shack", Lit up like a xmas tree!….It is less than 40 ft. from my neighbors house, and less than 75 ft. from my house….We went to the Beer Board meeting. Small town rumor, "done deal".. Now, he’s run his mouth, "it WILL be a strip club". Beer board says "you open a strip club, yank the beer license", (yeah, ok. "good ole’ boy system…." The SCHOOL bus stop is the parking lot next door!!! (sorry, but TRUE, swear to God!) Dirty Underwear, tacked to building. Broken glass, fights, gunshots, syringes, loud, people knocking at your door ath 3am…….
yada, yada, yada. DOES IT MAKE OUR PROPERTY UNSELLABLE????????
I meant to say….It DOES make our property, "UNSELLABLE" to an out of state person who may want to retire here. I live in a classified "RESORT" area…..less than 3, 2, 1 miles to the Tennessee State Park, Paris Landing, Tennessee. 350,000 acres of water!!!….
This year coming up in America, is Historical. 75 million people are Retiring this coming year!! Where I live is growing, nicely. Like it is suppose to for the area and what year it is!
Now, along with all the new "Classy" businesses that have recently been built, etc.
here we have a "Sleeze Fest" within "SPITTING" distance, and, "sorry"……
SOMEONE, HAS TO KNOW, where….
I can find the LAWS pertaining to this….ok, go to Tennessee.gov…..Been there, done that!
you get some "school type" crap that just beats you around the bush…I want to look up the LAW, without going to "The" or "Law" Libraries….Two mom’s waiting for a really smart person to help us with our dilemma/question…get a lawyer…$$…No,SMART, no need..
NO, where I live is soooooo nice!!
Biker,s Truckers, Mom’s, and what ever the song says…So many different folks. .Laid back, and one of a kind of sorts……No, sometimes the ones with the Money and/or Power, LOSE!!!!!!!!!!!

Sell it to him so he can expand his business, perhaps set up a rent by the hour hotel.

I wouldn’t buy a house next to an all night club of any sort, and find it odd that the zoning laws would allow such a business to function in a residential area. Local ordinances should provide you some cover for the quiet enjoyment of your home - or rezone your property so that other commercial interests can buy you out.

I’d be sitting first row at the next town council meeting if I were you. And I’d have the neighbor who’s 40ft from the property in tow!

Does your City have a zoning ordinance? That is the first step in addressing your situation. In order for the Sugar Shack to operate, it must conform to the zoning classification for that property. I would check that out first. Secondly, does the zoning ordinance or municipal ordinance allow the Sugar Shack to have a liquor license if there is adult entertainment? Some states do not allow alcohol in those types of establishments. If the Sugar Shack is operating legally, then the next thing you can do is work to oust your elected officials. If you can get yourself, or others who share your opinions elected, you can amend the zoning and/or municipal codes to either eliminate this type of use from your City, or make it very difficult. The Sugar Shack must also respect your rights as a property owner. You have the right to quiet and peaceable enjoyment of your property. This means, he can be forced to erect a fence or take other similar means to avoid noise, trash, etc. from disturbing you. Good luck.

It’s not a law, it’s an ordinance that governs strip clubs.

Call the zoning department of your city, and they should be able to tell you, but keep in mind…SOMEONE issued that individual a business license.

If your city has no zoning regarding strip clubs, then unforunately, you are out of luck.

There are no state or federal laws prohibiting the free market (sorry). However, locally the city government can control which businesses are allowed to get a license and where they will be located. Your city counsil is who you need to talk to.

You should call the school board as well and ask to have teh bus stop relocated.

Unfortunately, unless you have some backing from city zoning on this, you are stuck with a bad neighbor. Perhaps your town has some nuisance property ordinances you could work on with your neighbors. Ask at code enforcement about how this works, and as a concerned citizen, what you can do to help. Either the business will comply or be fined out of existance.

I have no idea what you are saying and I hope that I am the only one who answers so I can get the best answer by default.

I know you can call your local County Office and explain your concern in your community. Start with the administration office and they can usually direct you to the right person. Also, look on this website about obtaining information

    http://www.dre.ca.gov/default.htm

That’s California’s department of real estate - there may be information there - not sure though. Also try your local housing department.
