Nov 05, 09 at 7:52 amYou need to be working thru the lender. Pretty much every modification firm is a scam.
Try a manager

Nov 05, 09 at 12:46 pmYou don’t need a lawyer. What is it you are really trying to do? Modify your loan? If so, why? Did you lose some income? You must still be paying your mortgage on time somehow as they aren’t paying any attention to you. Something don’t make sense here. If you still have good credit I suggest you get a refinance loan to lower your payments. Otherwise, if you have an escrow where the bank holds your taxes and insurance in a account, look for cheaper insurance rates and argue the taxes you pay on the property in order to reduce your monthly payments.
If you start getting behind on your mortgage they will surely start paying attention to you.

Nov 05, 09 at 1:05 pmThis is normal, I’m afraid. There’s a huge crowd of people trying to do the same thing.
Keep calling, nicely, but persistently. By being nice, you have a better chance of getting what you want. Underwriters and processors are only human, and if you get nasty, you’re likely to be declined because that’s the end of you. If you try to force a decision before I can give it, I’ll have to say no. (That’s theoretical, this isn’t what I do.) If you’re nice, but call me every day, eventually you will get to the top of the enormous stack of applications (again, this is figurative since there’s very little actual paper involved) sooner without me being p-o’d.

Nov 05, 09 at 2:45 pmDo not bother with any attorney, since there is nothing an attorney can do which you cannot do yourself. Understand that your lender is NOT required by law to modify your loan. Since your original mortgage contract is valid and enforceable, there are no ‘law issues’ with which an attorney can work. You will need to be patient, regularly contacting the modification department of the lender to learn about progress of the request, and to provide any further documentation needed.
If you engage an attorney, the lender will be LESS inclined to grant your request, since they will understand that you can afford an attorney, and can as well afford your mortgage.
