Are General Power of Attorney papers worthless?

On June 29, 2009 / By Real Estate Law Help / In Real-Estate-Contracts

I am General Power of Attoney for my 86 year old father who has the start of Alzheimers Disease. My father signed a real estate contract to sell his house. The real estate agent told me that the power of attorney paper is basically worthless that my father can do what ever he wants and I have no say in the matter. Is this true? Should my next step be talking to an attorney?

Well it depends on if you have your father declared incompetent. If you have, then they certainly are not worthless. You should have a doctor evaluate him to see if he actually has Dementia or is just a conchity old man.

I would have to say he would unless you have him looked over by a doctor and have that disease diagnosed and in paper. But if you could not receive that statmant by the doctor he could go with the sale and there is no way that you could stop him. If you show that though you might lose him to a nursing home.

No, you have the power to say no, it’s obvious the agent is desperate for the sale.
