Feb 04, 09 at 2:17 amYou would have to be able to prove that the previous owners knew about the problem and knowingly did not disclose the problem. If your inspector didn’t notice the problem either, it would be hard to prove that the owners knew. Were the owners living there right up until you bought it? The problem may have occurred after they moved out. If they were living there, was it a problem that would have been obvious them? Check with the neighbors and see if they talked to the previous owners about the problem before you bought it. Then you would have some witnesses to back you up. Good luck. Next time when you buy a house, ask about American Shield home owner warranties that would have covered those sort of problems. There’s other companies other than American Shield but when I was a realtor we recommended that to our clients if they wanted it.
Edit: I thought plumbing problems was definitely covered. Weird. Did your coverage lapse or not cover the new house? It sounds like the insurance company needs a demand letter from a licensed attorney. I would check your plan coverage and see if it was supposed to cover it and get a lawyer to deal with them if they’re playing hard ball. 8k is worth an attorney visit.
