Texas Real estate Q: can I buy a home if I’m separated (North Carolina)?

On May 12, 2008 / By Real Estate Law Help / In North-Carolina-Real-Estate-Law

North Carolina divorce law requires that a couple be separated a year before they can divorce. I’m living in Texas now and have several months before I can divorce. Our separation agreement isn’t done yet but we have established our "separation date" which like a time stamp on everything that happens from here on out for us.

Does Texas lawy allow me to buy a home in Texas even though my out-of-state divorce won’t be final till early next year? (Seems a waste to rent for a year when I know where I’m going to be.)

create an LLC or a small corporation
and buy it as a company asset.

    available for further consultation

Texas is a community property state. If you have the cash, you can buy anything you want to - your husband will own half of it. If you’re getting a loan, your spouse must sign as a non-purchasing spouse, to allow you to place the family into debt.
    Wait until you are divorced.
