Help with New Mexico Real Estate Laws?

My best friend and I had an apartment in Albuquerque NM we lived there for 6 months and complied with our lease 100%. When we moved out the property manager at the apartment complex said that she would send our deposit to us in the mail and that we would recieve the 495 dollars out of a 500 dollar deposit for a lost key. It has been 3months now and we have not recieved anything. All I can find out about the RE laws for NM online is that they have 45 days to return the deposit… I am a licensed in Texas and there you have 30 days and if it is not returned the property manager must give you back your entire deposit x3 for damages… does anyone know if I can get 3x the deposit for damage…. I am not the type to unfairly try to get money from someone… but she had avoided my room mate and I like the plague and has been very rude to us so I want to get as much as possible… thanks for your help

It’s been YEARS since I’ve done a landlord tenant case (when I worked for NM Legal Aid) but there was no statutory authority for 3X damages back then and I don’t recall seeing anything in the Bar Bulletin saying it’s been changed but it might have been. I just doubt it because we have a very strong landlord’s lobby here in New Mexico, it’s very hard to get strong laws protecting tenants because tenants don’t organize and try to protect themselves.

However, either the Legal Aid Socity of Albuquerque (LASA, now just part of NM Legal Aid) or some other organization had a website that explained landlord tenant law. I’ll see if I can find it and give you the link.
