If I sublet part of the home that I recently purchased and live in, could I get the $7500 rebate?

Subletting part of the home would, I think, make that part of the home commercial real estate for taxation purposes. What if I buy the home in 2009 and do not sublet until after the subsequent tax filing? I want to make sure that I am not breaking any laws. Thanks.
I have not purchased the home. I should have stated that the question is hypothetical and that I am thinking of purchasing.

    Did you purchase or not? Your other question makes this confusing. Rather than worry about the rebate that I do not believe exists yet, you should be worried about the terms of your mortgage.
